<p>Congressional Republicans have <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.epw.senate.gov%2Fpublic%2Findex.cfm%3FFuseAction%3DFiles.View%26amp%3BFileStore_id%3D8b756c0f-44ad-4a7a-988f-d2602c40a4ac">attacked</a> the Obama administration by accusing federal agencies of engaging in collusive litigation practices with public interest groups (pejoratively dubbed “sue-and-settle”). Republicans in both the 112th and 113th Congress have introduced legislation that purports to address this practice. Senate Republicans have most recently leveled similar accusations at Ms. Gina McCarthy during the confirmation proceedings for her nomination to be the next <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.epa.gov%2F">Environmental Protection Agency</a> (EPA) Administrator.</p>
<p>Yet when railing against this alleged practice, these members of Congress have failed to substantiate their charges with actual proof. And they never acknowledge the harmful consequences that the extreme bills would produce.</p>
<p>The so-called “Sunshine for Regulatory Decrees and Settlements Act” (introduced in slightly different forms as <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fthomas.loc.gov%2Fcgi-bin%2Fquery%2Fz%3Fc112%3AH.R.3862.RH%3A">H.R. 3862</a> in the 112th Congress and <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fthomas.loc.gov%2Fcgi-bin%2Fbdquery%2FD%3Fd113%3A1%3A.%2Ftemp%2F%7Ebd90ge%3A%40%40%40L%26amp%3Bsumm2%3Dm%26amp%3B%257C%2Fhome%2FLegislativeData.php%257C">S. 714</a> in the 113th Congress) <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.grassley.senate.gov%2Fnews%2FArticle.cfm%3Fcustomel_dataPageID_1502%3D45458">creates</a> the legal opportunity for third party “intervenors” to obstruct settlement talks and prolong illegal, harmful actions when federal agencies are sued for violating federal laws.</p>
<p>Specifically, the bills create a presumption requiring courts to allow non-party industry intervenors to participate in federal agency settlement discussions. The bill also establishes devious means by which these intervenors may disrupt and obstruct the settlement of lawsuits that the government believes should not be defended in court.</p>
<p>Let&#8217;s be clear. Sponsors of these extreme bills want industry intervenors to be given the right to participate in settlement discussions to argue that agencies like the EPA have not broken the law—even when agencies admit that they have. These industry intervenors would like to oppose rulemakings and schedules to remedy the legal violations, over the objections of injured plaintiffs, even when the agency is willing to follow the law and correct its illegal behavior.</p>
<p><a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=https%3A%2F%2Fwww.law.upenn.edu%2Fblogs%2Fregblog%2Fenvironmental%2520law.jpeg"><img alt="environmental law.jpeg" src="http://bizlawnews.com/wp-content/uploads/2013/05/environmental%20law-thumb-350x232-187813.jpeg" width="350" height="232" class="mt-image-right c6" /></a>Under current law, third party intervenors have no legal right to participate in settlement discussions involving any party, whether government, private entity, or individual. For example, in a lawsuit by female employees against a national supermarket chain over claims that they are paid less than their male co-workers, Congress does not (and should not) give male employees the right to participate in and block settlements between the supermarket and the female workers because the men want the pay discrimination to continue.</p>
<p>However, this is precisely what the described legislation would foster by allowing unlawful federal agency action or inaction to persist and the promise of health and safety protections to remain unfulfilled.</p>
<p>Statutory deadlines are written into many federal statutes, and these congressional deadlines ensure that statutes are carried out to advance important safeguards for public health, the environment, workers, consumers, and investors. <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.nyls.edu%2Ffaculty%2Ffaculty_profiles%2Fdavid_schoenbrod">David Shoenbrod</a>, a witness at the hearing for H.R. 3862, <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fjudiciary.house.gov%2Fhearings%2FHearings%25202012%2FSchoenbrod%252002032012.pdf">testified</a> that EPA has met only “14 percent of the hundreds of deadlines set for it by Congress.”</p>
<p>When such a deadline passes, Congress has empowered citizens, states, and corporations to enforce the law against wayward federal agencies for their failure to meet statutory deadlines and other legal responsibilities. The judiciary oversees enforcement of these statutory requirements in court and by approving settlements agreements and consent decrees.</p>
<p>What’s more, current law is replete with legal mechanisms that ensure adequate public participation, transparency, and fulsome rulemaking procedures before agencies commit to binding, substantive decisions with the force of law.</p>
<p>Take, for example, EPA’s recently finalized mercury and air toxics <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.epa.gov%2Fmats%2Fpdfs%2F20111221MATSimpactsfs.pdf">standards</a> for power plants. EPA missed a mandatory statutory deadline by nearly 10 years to promulgate national standards that would for the first time limit mercury, arsenic, and acid gases emitted by fossil fuel-fired power plants.</p>
<p>When sued, EPA agreed in a consent decree to propose standards by a certain date and to finalize standards by a later date. The agency did not (and could not) commit to a particular outcome or policy position. Consistent with the <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.epa.gov%2Fair%2Fcaa%2F">Clean Air Act</a>, EPA solicited public comment on the consent decree. Power industry intervenors not only opposed the rulemaking schedule but also argued (unsuccessfully) that EPA was forbidden from adopting the long overdue standards. (The judge declined to credit these arguments and approved the decree.) Later, when EPA proposed standards, it provided nearly 140 days of formal public comment opportunity, and then finalized toxic air pollution standards for power plants. At that point, industry parties brought lawsuits challenging substantive and procedural aspects of the new standards.</p>
<p>Today’s legislative proposals would upend this process. These radical bills are actually designed to enhance the ability of industry intervenors to thwart the obligation of agencies like EPA to follow the law and reduce hazards to the public that occur when industry fails to comply. (Indeed, industry challengers to the mercury and air toxic standards testified that their experience was a prime reason they believed the House bill was necessary.) No longer would a federal agency be able to resolve litigation early in the process by settling lawsuits that it would clearly lose.</p>
<p>Instead, industry intervenors would oppose rulemaking schedules that agencies agree to meet to remedy missed statutory deadlines. This would further harm already injured plaintiffs and the public, increase transaction costs for the parties, and unnecessarily waste the resources of an already strained judicial system. This directly conflicts with the widely accepted <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.law.cornell.edu%2Frules%2Ffre%2Frule_408">policy</a> of the federal judiciary that favors the “compromise and settlement of disputes,” and ignores the very reason that deadline suits are brought in the first place.</p>
<p>A group of Senate Republicans recently demanded that EPA promise to allow industry intervention in agency settlement talks, implying they would filibuster Ms. McCarthy&#8217;s nomination otherwise. EPA <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fswitchboard.nrdc.org%2Fblogs%2Fjwalke%2FMcCarthy%2520transparency%2520blog%2520post%2520attachment%25202.pdf">responded</a> to the demand thusly:</p>
<p>[T]he EPA and the Department of Justice must have latitude to respond to [litigation against the government], on a case-by-case basis, in a manner that serves the public interest and is fully consistent with the government’s legal obligations. The EPA is unaware of any precedent for the U.S. Government, or any federal agency, to take such a sweeping position [guaranteeing intervenor participation], constraining the conduct of its defense in lawsuits brought against the government.</p>

This is what is really going on. Lacking the votes to amend and weaken the substantive laws that federal agencies enforce, some Congressional Republicans are resorting to indirect attacks designed to obstruct enforcement of federal laws administered by agencies. Their extreme anti-enforcement bills are intended to constrain the government&#8217;s conduct defending itself against lawsuits, and to undermine the executive branch&#8217;s legal obligations to follow the law. Without so much as debating the merits of substantive statutes whose enforcement they seek to undermine, the proponents of these bills seek to thwart and effectively alter federal laws too popular to be weakened by direct amendment.
<p>In purporting to solve a problem that has not been shown to exist, and seizing on a &#8220;solution&#8221; that mandates industry intervention in agency settlement negotiations, these political efforts represent irresponsible attempts to weaken federal laws and their enforcement. The efforts are just as extreme as the direct conservative attacks on regulatory safeguards that failed during the 112th Congress, and the anti-enforcement bills should fail for the same reasons.</p>

<p>According to Lytton, only 8% of kosher consumers are religious Jews who buy exclusively kosher food. Most consumers buy kosher food for reasons related to food safety, health, allergies, or religious restrictions such as halal. </p>
<p>The system of private third-party kosher certification of industrially prepared and packaged food began in the second half of the twentieth century following decades of fraud and corruption in kosher meat production. A network of professionalized certification agencies replaced individual rabbis who had historically overseen kosher food production. </p>
<p>Today, in order to obtain kosher certification, a food producer signs a contract with a certifying agency.  Monitoring is conducted on an on-going basis and fees vary based on the nature of the production.  While there are over three hundred kosher certification agencies in the US, a group known as the “Big Five” control 80% of the market.</p>
<p>Professor Lytton found that private kosher certification agencies overcame a number of common sources of regulatory failure, such as regulatory capture, insufficient resources, and inadequate enforcement.  In his talk, Professor Lytton pointed out that, today, kosher fraud is extremely rare, and that when it does occur, agencies are quick to alert consumers and order product recalls.  </p>

<p>Professor Lytton argued that the relative lack of fraud in the kosher food industry can be partially attributed to a core of vigilant consumers.  He explained that the 8% of religiously observant kosher consumers who eat only kosher food frequently discover problems and alert agencies. They also spread agency alerts through social networks, enhancing consumer protection. In addition, these consumers keep the agencies on their toes. The agencies are careful to avoid mistakes and prevent misconduct in order to maintain their reputation for reliable certification. </p>
<p>In the end, Lytton concluded that kosher certification provides a successful model of reliable private certification that could point the way to reforming other forms of private third-party regulation that have not performed as well, such as private food safety audits and front-of-package nutritional labeling.</p>

<div>In their statements, Democratic senators <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.epw.senate.gov%2Fpublic%2Findex.cfm%3FFuseAction%3DHearings.Hearing%26amp%3BHearing_ID%3D670b95e6-ae45-33e6-edac-c256181b8e10">praised</a> McCarthy for her bipartisan work at the state level.  They also voiced appreciation for her ability to work with industry leaders and her history of bringing together diverse and opposing stakeholders.  The Democrats also applauded her pragmatic methods and dedication to common sense strategies.</div>
<div>However, McCarthy received a much different reaction from Republican senators, who recently sent McCarthy a <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.epw.senate.gov%2Fpublic%2Findex.cfm%3FFuseAction%3DFiles.View%26amp%3BFileStore_id%3D0c583654-d99a-41c7-998a-e72f4cf0d09f">letter</a> outlining their concerns over the EPA’s lack of transparency.  The Republicans <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.epw.senate.gov%2Fpublic%2Findex.cfm%3FFuseAction%3DHearings.Hearing%26amp%3BHearing_ID%3D670b95e6-ae45-33e6-edac-c256181b8e10">stressed</a> their disapproval of what they characterized as “backroom <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.jdsupra.com%2Flegalnews%2Fsue-and-settle-the-growing-problem-of-16599%2F">‘sue and settle’</a> deals”—where an interest group sues the EPA and, at settlement, requests stricter rules or new regulations.  In response to these charges, McCarthy stated that these agreements are made by the EPA and the <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.justice.gov%2F">U.S. Department of Justice</a> (DOJ), with full notice given to the public.  Moreover, McCarthy pointed out that proposed settlement agreements under the Clean Air Act (CAA) are published in the <em>Federal Register</em> and open for public comment.</div>

<p style="text-align: justify;" align="center">The San Jose City Council, facing huge budget deficits tried to honor the will of the people by terminating life-time pension benefits for Council members.  But they just learned ending wildly expensive retirement benefits may be wildly more expensive than staying in the plan.</p>
<p style="text-align: justify;" align="center">The California Public Employees’ Retirement System (CalPERS), which manages most public employee retirement benefits in California raised San Jose’s cost of checking-out of the pension plan by 584%.</p>
<p>Mayor Chuck Reed leads a conservative council majority in San Jose that have been battling to cut operating costs to keep the town of one million people from being forced to declare bankruptcy.  The city’s largest and fastest growing liability is cost to fund their public employees’ defined benefit pensions that are invested by CalPERS.</p>
<p>During the hot stock market in the late 1990s and legislation from Sacramento, San Jose and most state and local governments spiked life-time pension benefits for union employees and the city council members by 60%.  Thirteen years later, annual pension costs per employee have tripled, burdening San Jose with a $2.9 billion unfunded pension liability.  This liability equals $2,900 for every man, woman and child in the city.  But since only 46% of residents work, the liability is $6,304 per working Californian.</p>
<p>The city’s pension plan covers 7 current elected officials and 20 former mayors and council members.  Ten of the former officials already are drawing retirement benefits.</p>
<p>By law if the plan is terminated, the retired officials will continue to receive their pensions and current council members would keep the value of the benefits they have already accrued.  Facing staggering budget challenges, the council voted unanimously last January 2012 to terminate their own pension plan as a demonstration of leadership when they asked unionized city employee’s to accept pension benefit reductions.</p>
<p>San Jose voters in June approved a city council sponsored measure reducing pensions for new hires and calling for current employees to pay more each month for their pensions or accept a lower benefit formula for their remaining years on the job. The city’s unions have filed a law suit and both sides expect a battle.</p>
<p>Having voted to terminate city council defined benefit pensions, Mayor Reed appointed the city’s Human Resources Department to handle the paper work.  While the council’s pension benefit costs were considered small at less than $100,000 per year, the public voiced strong support for the council’s gesture of moral leadership.</p>
<p>The solvency of San Jose’s city council pensions was reported last year by CalPERS to be 72% funded and had a stated liability of $976,000, based on the agency’s assumption that the pension plan investments would earn 7.5% percent for each of the next 30 years.    But CalPERS told the city council to exit the pension plan would cost between $5 million to $5.7 million, approximately 584% more than the liability CalPERS had been annually reporting to the city.</p>
<p>It seems CalPERS’ expected return of 7.5% per year is only for participants that stay in the plan.  CalPERS hammers participants when they want to check-out of the plan by whacking their future estimated return down to the U.S. government bond yield, which is 2.4% right now.</p>
<p>San Jose’s city council pension plan only allows full retirement at age 55, pays 2% of salary for every year worked, and adds a 2% cost-of-living raise each year.  These benefits generate an annual pension payment of $13,000 per council member.  This benefit is only 60% of what a San Jose union employee would receive.</p>
<p>CalPERS manages $262 billion in pension assets for 1,576 local governments pension plans that cover state workers and non-teaching employees in 1,488 school districts and agencies.</p>
<p>The pension plan claims in its’ latest financial report that it has an unfunded liability of about $100 billion.  But if required to pay at the same rate they demand from San Jose City Council to check-out of the pension plan, CalPERS unfunded liability would be $584 billion.</p>
<p>As the Eagles warned when entering the Hotel California: “<i>This could be Heaven or this could be Hell</i>.”</p>

<p itemprop="articleBody">After an unproductive year, during which Playsafe achieved no sales to a single consumer, United Medical Devices terminated Playsafe&#8217;s contract.  Playsafe sued for breach of contract and fraud, seeking <span>$10.5 million</span> in damages.  United Medical Devices also sued Playsafe, seeking <span>$700,000</span> due under the contract. </p>

(NYSE MKT: PTN), a biopharmaceutical company developing targeted, receptor-specific peptide therapeutics for the treatment of diseases with significant unmet medical need and commercial potential, announced today that the United States Patent and Trademark Office (USPTO) has issued a Notice of Allowance for U.S. Patent Application Serial Number 12/952,238 (the &#8217;238 application).  The application includes composition of matter claims on a new class of melanocortin receptor- specific peptides for sexual dysfunction and other indications.</p>
<p itemprop="articleBody">The &#8217;238 application is the first patent application to issue covering a novel family of melanocortin-4 receptor agonist peptides.  The melanocortin-4 receptor mediates sexual response, and agonists have been studied for treatment of both erectile dysfunction and female sexual dysfunction.  Palatin&#8217;s bremelanotide product, a melanocortin-4 receptor agonist peptide drug administered using an autoinjector, has recently completed Phase 2 human studies for female sexual dysfunction, with pivotal Phase 3 clinical studies scheduled to start later this year.</p>
<p itemprop="articleBody">The peptides in the &#8217;238 application demonstrated effects on sexual function in animal models.  Palatin is evaluating these peptides as potential follow-on or second generation products for treatment of sexual dysfunction.  The melanocortin-4 receptor also has potential utility in treatment of obesity, metabolic syndrome and other indications.</p>

				<content:encoded><![CDATA[<p><a href="http://bizlawnews.com/wp-content/uploads/2013/05/Stormwater-thumb-350x232-12641-e1367644934817.jpg"><img class="alignleft size-full wp-image-19587" style="border: 1px solid black; margin: 5px;" alt="Stormwater-thumb-350x232-12641" src="http://bizlawnews.com/wp-content/uploads/2013/05/Stormwater-thumb-350x232-12641-e1367644934817.jpg" width="300" height="199" /></a>When the <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.epa.gov%2F">Environmental Protection Agency</a> (EPA) wrote Senator Charles Grassley two letters discussing water treatment regulations, the agency probably did not think it was crafting new regulations.  However, a federal appeals court recently <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.ca8.uscourts.gov%2Fopndir%2F13%2F03%2F113412P.pdf">disagreed</a> and vacated the letters for violating the <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.archives.gov%2Ffederal-register%2Flaws%2Fadministrative-procedure%2F">Administrative Procedure Act</a> (APA).</p>

<p>The case began when the <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=https%3A%2F%2Fwww.iowaleague.org%2FPages%2FHome.aspx">Iowa League of Cities</a> petitioned the United States Court of Appeals for the Eighth Circuit.</p>
<p>The case focused on two areas of water treatment regulation: the use of “mixing zones” in areas where sewer outfalls meet the bodies of water they are emptying into, and “blending,” which involves the use of chemical processes as a substitute for traditional, biological-based secondary sewage treatment.</p>
<p>The Clean Water Act <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.law.cornell.edu%2Fuscode%2Ftext%2F33%2F1311">prohibits</a> the discharge of pollutants from a point source, such as a sewer outfall, in a manner that does not comply with the act.   When a mixing zone is authorized, a permit holder does not have to comply with effluent limitations directly at the point of the sewer outfall.  In other words, the water coming out of the end of the pipe is allowed to be more polluted than regulations would typically allow.  The pollutants are instead allowed to diffuse into the waterway before a measurement for compliance occurs.</p>
<p>In 2011, Senator Charles Grassley sent a request to the EPA, on behalf of the League of Cities, asking for clarification on when states are allowed to authorize mixing zones in their implementation of the federal Clean Water Act.  According to the court, the EPA responded by stating that mixing zones “should not be permitted where they may endanger critical areas,” such as “recreational areas.”</p>
<p>The EPA was particularly concerned about allowing mixing zones near recreational areas where people swim or come into contact with the water.The court had to grapple with whether the EPA’s position was a departure from its earlier guidance on state-authorized mixing zones.</p>
<p>The League of Cities argued that what the agency wrote in its letter to Senator Grassley amounted to a new regulation that was inconsistent with the EPA’s prior guidance on the subject and should be vacated.The court agreed that the letter shifted the EPA’s position from sometimes allowing states to authorize mixing zones near recreational areas to never allowing states to authorize them near recreational areas.</p>
<p>It then considered whether the position outlined in the EPA’s letter was binding upon water treatment facilities and state agencies.  If so, then the EPA had articulated what amounted to a rule and was bound to follow the procedures for notice-and-comment rulemaking laid out in the APA.</p>
<p>The court held that the EPA’s use of the phrase “should not be permitted” was binding because it “spoke in mandatory terms.”  The court was further persuaded by affidavits from representatives of municipal waste water facilities and the <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.iowadnr.gov%2F">Iowa Department of Natural Resources</a> (DNR) that suggested they were interpreting the letters as a binding rule.</p>
<p>For its part, the EPA argued that the letter was not binding and that the <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.law.cornell.edu%2Fcfr%2Ftext%2F40%2F131.13">governing regulations</a> left the use of mixing zones up to a state’s discretion.  The court strongly <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.ca8.uscourts.gov%2Fopndir%2F13%2F03%2F113412P.pdf">rejected</a> this position, characterizing it as “Orwellian Newspeak.”  Finding that the letter amounted to a legislative rule, the court held that the APA applied, and that the EPA had not adhered to its procedural requirements.  The court vacated the letter.</p>
<p>The court also scrutinized a second EPA letter to Senator Grassley that focused on “blending.”  Treatment facilities usually pass sewage through primary and secondary treatment.  Secondary treatment is usually a biological-based process, although this <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fgovernor.utah.gov%2Frdcc%2FY2003%2F03-3466.pdf">is not mandated</a> by regulations.</p>
<p>Treatment facilities generally have a higher flow capacity for primary treatment than for secondary treatment.  This can create a bottlenecking problem during storms, where the influx of extra rainwater or snowmelt pushes total flow beyond the facility’s secondary treatment capacity.  The problem is compounded because regulations <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.law.cornell.edu%2Fcfr%2Ftext%2F40%2F122.41">prohibit</a> treatment facilities from “bypassing” the secondary treatment process during peak flows.</p>
<p>If a treatment facility is overwhelmed, and the facility does not allow sewage to bypass secondary treatment, sewage <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.basementfloodreduction.com%2Ftheproblem%2Fsewerbackup.html">can back up</a>, spilling out onto streets and into homes.  Treatment facilities typically opt to release sewage that has not been fully treated into rivers or lakes rather than allow this to occur.</p>
<p>One solution treatment plants have considered is “blending.” In this process, plants <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.veoliawaterst.com%2Factiflo%2Fen%2F">use</a> chemical and physical treatment methods to replace the traditional biological-based approach for a portion of the flow.  This portion is then blended with the flow that passes through the biological based process before being discharged.  The dispute before the court in the recent case focused on whether “blending” constitutes a prohibited bypass.</p>
<p>The EPA <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.cnie.org%2FNLE%2FCRSreports%2F04may%2FRL32384.pdf">considered</a> allowing the process in 2003, but in 2005 the agency <a href="http://redirect.viglink.com?key=11fe087258b6fc0532a5ccfc924805c0&amp;u=http%3A%2F%2Fwww.epa.gov%2Fnpdes%2Fpubs%2Ffr_peak_wet_weather_policy.pdf">published</a> a proposed policy stating that it was acceptable only if there was “no feasible alternative.”  No formal rule was ever finalized, however.  In 2011, in a letter to Senator Grassley, EPA reiterated the position laid out in the proposed policy and stated that the League of Cities could only use “blending” if there was no feasible alternative.</p>
<p>The court held that the letter amounted to a new legislative rule.  Once again, the court held that the agency had promulgated a rule and that the APA applied.  It vacated the letter on procedural grounds.Although the court found the letters to be procedurally invalid, it declined to address whether the EPA had the authority to issue such rules in the first place, even if the agency had followed proper procedures.</p>
